The Wawa data breach settlement is a consumer class action settlement worth up to $9 million in cash and Wawa gift cards that resolved claims over the 2019 payment-card breach at Wawa, the East Coast chain of convenience stores and gas stations. The case, In re: Wawa, Inc. Data Security Litigation, No. 2:19-cv-06019, was decided in the U.S. District Court for the Eastern District of Pennsylvania before Judge Gene E.K. Pratter. It followed point-of-sale malware that ran on Wawa's checkout terminals and fuel-pump card readers from about March 4 to December 12, 2019, exposing card numbers, names, and expiration dates on roughly 30 to 34 million payment cards. A later appeal disputed only the plaintiffs' attorneys' fees — the Third Circuit sent the $3.2 million fee award back for review in 2023 and then affirmed it on June 25, 2025 — so the consumer benefits themselves were never reduced.

Who qualifies
- You are a U.S. resident who used a credit or debit card at a Wawa convenience store or fuel pump at any time between March 4 and December 12, 2019 — the period the point-of-sale malware was active.
- Tier 1: a $5 Wawa gift card was available to anyone who used a card in the window and attested they spent time monitoring their accounts, with no proof of fraud required.
- Tier 2: a $15 Wawa gift card was for people who had an actual or attempted fraudulent charge that was reversed, with proof of the transaction.
- Tier 3: cash up to $500 was for documented out-of-pocket losses tied to the breach — there was no higher $5,000 consumer tier.

The deadline to file was November 29, 2021. This was a claim-based settlement — there were no automatic payments — so if you did not submit a claim by that date, you are not entitled to a payment. There is no way to file a new Wawa claim in 2026.

Judge Gene E.K. Pratter of the U.S. District Court for the Eastern District of Pennsylvania granted final approval on April 20, 2022 in In re: Wawa, Inc. Data Security Litigation. Valid claimants then received their $5 or $15 Wawa gift card, or their cash payment of up to $500 for documented losses.

The appeals were about attorneys' fees, not your payout
An objector challenged the $3.2 million in attorneys' fees. The Third Circuit vacated that fee award for a closer look on November 2, 2023, and after the district court re-examined it, the Third Circuit affirmed the $3.2 million fee on June 25, 2025. The consumer gift-card and cash benefits were not changed by any of the appeals.

The consumer settlement is separate from the bank and state deals
Wawa also reached a separate financial-institution settlement of up to $28.5 million (paid to banks and credit unions for reissuing cards) and an $8 million multistate Attorney General settlement in July 2022 (paid to the states). Neither of those put money in customers' hands — only the up-to-$9 million consumer settlement did.
