How we verify settlements

People who leased a unit at Avondale Apartments in Denver during the covered period, and qualifying adult household members listed on the lease, are eligible for an automatic settlement check if the court grants final approval. The base share depends on the number of months they lived at Avondale.

There is a separate claim for additional money for eligible tenants whose disability affects their mobility or ability to use stairs. To claim a Fair Housing Subclass payment, submit the official claim form with medical documentation of the qualifying disability. Submit online, email the form, or mail it with a postmark by January 2, 2027.

Who qualifies

  • The general class includes people in the United States who leased a residential unit at Avondale Apartments during the covered period, June 6, 2022 through November 3, 2026. It also includes members of those households who were identified on the lease, had the right to occupy the unit and were adults when notice was provided.
  • For the additional Fair Housing Subclass payment, you must also have a disability that qualifies under the Colorado Fair Housing Act and that affects your mobility or ability to ascend or descend stairs. General class membership alone qualifies you only for the base share.
  • The agreement excludes the presiding judge or magistrate and their families, the defendants and specified related entities, principals, contractors, employees, officers and directors, people who timely opt out, people whose claims were finally adjudicated or otherwise released, counsel for both sides, and legal representatives, successors and assignees of excluded persons.

Frequently asked questions

Do I need to file for my regular class payment?

No. Eligible general class members who stay in the settlement receive their share by mailed check if the settlement becomes effective. Only the additional Fair Housing Subclass benefit requires a claim.

How is my base share calculated?

The agreement starts with a $2 million gross settlement. After approved fees and costs, administration expenses, service payments and subclass payments, the remaining base fund is divided by the total months of residency of settlement class members. Your share is that amount per month multiplied by your covered months of residency.

How much is the additional subclass benefit?

The agreement initially reserves $141,823.51. It divides $70,911.75 evenly among qualifying subclass members and allocates $70,911.76 proportionally based on residency months during the period from June 2022 through the month notice was issued. The agreement caps the individual subclass payment at $10,000. Excess and residual subclass funds return to the general class fund. Your actual amount depends on eligibility and the distribution calculation.

What proof should I provide?

The long-form notice specifically requires medical documentation of your qualifying disability. You must submit the official subclass form and demonstrate that your disability affects your mobility or ability to use stairs. Follow the instructions on your individual form. No medical documentation is required to receive the automatic general class share.

How can I get the correct form?

Use the official claim entry with the CPT ID and passcode from your mailed notice. If you lack credentials or need the subclass form, contact CPT Group using the administrator contact information. The notice PDF’s last page is an opt-out form.

When will the court decide whether to approve the settlement?

The filed hearing notice schedules an in-person final approval hearing for March 4, 2027 at 1:30 p.m. Mountain Time, in Denver District Court, Courtroom 424. Payment depends on final approval and the settlement becoming effective. The agreement calls for the first checks to be mailed within 28 days after the effective date.
