Who qualifies
- The class includes natural persons who lived at The Reserve at LaVista Walk, 1155 LaVista Road, Atlanta, Georgia, on November 10, 2023, together with their assignees, subrogated insurers and successors. The issued claim form treats residents aged 18 or older on that date as adults; children under 18 claim through a parent or legal guardian.
- Excluded are Charnelle Gunn, Robert Stokes, and people who previously settled, assigned or litigated to final judgment their fire-related claims. Valid opt-outs cannot receive settlement payments. Being a former resident on a different date is not enough.
How to file a claim
- 1
Choose the right form
Residents use the Individual Claim Form linked below. Each adult co-resident files separately; a parent or legal guardian may include their minor children on the same form. Insurers seeking reimbursement use the separate Subrogated Insurer Claim Form.
- 2
Establish residency and your losses
Provide your unit and required identifying/contact information. The form requests the last four digits of an SSN or TIN for U.S. residents. Leasing records may establish residency; otherwise supply a lease, rent record, utility bill or other reliable evidence. No dollar-loss documentation is needed for the adult displacement share. For property loss, list items, dates and values and attach supporting records, such as receipts, photographs, estimates or a signed itemized inventory.
- 3
Disclose insurance and child claims
For property claims, disclose coverage and proceeds, separating personal-property payments from additional living expenses or loss-of-use payments, and authorize verification. List co-residents to prevent duplicate property claims. For children, provide the requested identifying/residency details and evidence of your authority as parent or guardian; the plan also requires residency verification. Children do not make a separate documented property-loss claim.
- 4
Sign and submit by November 22
Sign the declaration under penalty of perjury, including truthfulness, residency, authority for child claims and no undisclosed duplicate recovery. File online at the official website or mail the completed form and supporting documents postmarked by November 22, 2026 to LaVista Fire Settlement, c/o Settlement Administrator, P.O. Box 25191, Santa Ana, CA 92799. The notice also lists email submission to info@lavistafiresettlement.com. Call 833-421-7358 for administrator assistance.
Separate claims for subrogated insurers
An insurer that paid personal-property proceeds for an eligible resident may file the Subrogated Insurer Claim Form by November 22, 2026. It must identify insured residents and policies, document payments and subrogation or assignment rights, separate additional living expenses/loss of use, and obtain an authorized representative’s signed certification. Recognized amounts are capped at the resident’s gross recognized property loss and share the same proportional payment rate as adult property claims. Insurers receive no displacement share.
As a condition of payment, effective upon payment, the insurer releases subrogation and reimbursement rights against the defendants and released parties, and against class members or authorized claimants, for the proceeds being paid. An insurer that does not timely file forfeits payment from the fund and remains subject to the settlement’s release and bar if effective. Read the insurer form for the complete terms.
Deductions and payment conditions
Court-approved attorneys’ fees, litigation expenses, administration costs, taxes and applicable opt-out reversions reduce the gross fund. The plan provides no service awards. The remaining property pool absorbs changes in these costs after the fixed displacement pool and child payments. The administrator may hold back funds for disputed claims or other obligations; a distribution may be withheld if its cost is impracticable. Tax reporting or withholding may apply.

Frequently asked questions
How much will each adult receive?
The $1.3 million displacement pool is divided equally among adult claimants with valid, residency-verified claims. An adult can receive this share even without a property-loss claim, including when insurance fully offsets recognized property loss. No fixed individual displacement estimate is established.
How are property-loss payments calculated?
After approved deductions, the net fund reserves $1.3 million for displacement. The property-loss pool first pays eligible children $2,500 each in full. The balance is divided proportionally between adults’ recognized property-loss claims and valid insurer subrogation claims. They share the same payment percentage. Adult losses are determined from the submitted evidence, with no guarantee of full reimbursement.
How does insurance affect my claim?
Personal-property insurance proceeds reduce an adult’s recognized property loss, capped at that loss and never below zero. Additional living expenses and loss-of-use proceeds are excluded from this offset. Insurers can claim the corresponding eligible amount using their own form; the same loss cannot be paid twice. Insurance does not eliminate a valid adult displacement claim.
What do children receive?
A child who was under 18 and lived at the property on November 10, 2023 may receive $2,500 through a parent or legal guardian. This flat amount covers all of the child’s displacement and property-loss claims, is paid before the adult/insurer proportional distribution, and is not reduced proportionally. The child gets no separate displacement share.
What if my claim is incomplete or denied?
The administrator issues deficiency or decision notices. The plan allows 30 days from a deficiency notice to supply missing information and 30 days from a decision notice to request reconsideration. Reconsideration concerns how the criteria were applied and cannot be used to add reasonably available evidence omitted from the original claim. Follow the notice you receive.
When will payments be made?
The issued notice schedules the final approval hearing for January 5, 2027 at 1:30 p.m. Eastern Time. Payments depend on approval, resolution of appeals and claim processing. The hearing may change, and no payment date is guaranteed.
What if I want to opt out or object?
The notice lists November 22, 2026 for exclusion requests and objections. These are different procedures from filing a claim. The signed order requires objections to be filed with the court and copied to the administrator; read the official notice and order for complete requirements. Doing nothing means no payment and may bind you to the release if the settlement becomes effective.
