How we verify settlements

ARcare has agreed to a $3.9 million settlement concerning unauthorized access to sensitive data between January 18 and February 24, 2022. The class includes living people residing in the United States who were sent notice that their private information may have been affected.

Eligible class members may choose up to $5,000 for qualifying documented losses or an estimated $100 alternate cash payment. They may also request one year of medical data monitoring. Cash payments can increase or decrease proportionally under the settlement allocation rules, so the stated amounts are not guaranteed awards.

Claims must be submitted electronically or postmarked by January 7, 2027. Benefits require a valid claim. The settlement fund also covers administration and court-approved legal fees, costs and service awards.

The case is Hale, et al. v. Arcare, Inc. in the U.S. District Court for the Eastern District of Arkansas. Benefits depend on final settlement approval; the official FAQ does not promise a payment date.

Official settlement FAQQ9

Who qualifies

  • You must be a living individual residing in the United States who was sent notice of the data incident indicating that your private information may have been affected.
  • Excluded are ARcare’s directors and officers, governmental entities, the judge assigned to the action, that judge’s immediate family and court staff.
  • Documented-loss claims require actual, documented, unreimbursed monetary losses more likely than not caused by the incident and incurred after the incident. Expenses already reimbursed by another source cannot be claimed again.

How to submit an ARcare settlement claim

  1. 1

    Check your notice and eligibility

Confirm that you received an incident notice and meet the living-U.S.-resident class definition. Review the official exclusions before filing.

  2. 2

Choose one cash option and any monitoring

Choose documented-loss reimbursement or the estimated $100 alternate cash payment. You may also elect one year of medical data monitoring.

  3. 3

Prepare documentation for a loss claim

Include reasonable records proving the loss and its connection to the incident. Your own certification, declaration or affidavit alone does not count as proper documentation, though it may explain other supporting records. Do not claim expenses another source has already reimbursed.

  4. 4

    File by January 7, 2027

Follow the official File A Claim instructions to submit electronically or mail a claim postmarked by January 7, 2027. The portal offers online filing for people with a Claim ID and PIN and a personalized paper-form option for people without them. No exact cutoff time or timezone is stated in the reviewed deadline instructions.

Frequently asked questions

Can I receive both $5,000 and $100?

No. The official FAQ describes documented-loss reimbursement and alternate cash as alternatives. You may also request medical data monitoring with either cash option. The $5,000 figure is a limit for qualifying documented losses, and $100 is an estimate.

Can the cash amounts change?

Yes. Cash payments may increase or decrease proportionally depending on valid claims and the net fund. The allocation pays monitoring first, then documented-loss claims, then alternate-cash claims. Adjustments use an equal percentage basis.

What documentation is required for a loss claim?

The loss must be actual, documented, unreimbursed, more likely than not caused by the incident and incurred after the incident. Personal statements alone are not proper documentation, but may explain other reasonable records. Unsupported or rejected claims that are not cured are rejected; the FAQ does not promise an automatic switch to alternate cash.

What monitoring is offered?

Class members may claim one year of CyEx Medical Shield Complete, including single-bureau credit monitoring and medical-data monitoring. The FAQ also describes identity-theft insurance and victim assistance. Insurance coverage is not a cash settlement payment.

When will benefits be distributed?

After the settlement is approved and becomes final. Appeals can delay distribution. The official FAQ does not promise a payment date.
