Official EFTA settlement FAQFAQ 6: released claims
Who qualifies
- You submitted a dispute or claim to Bank of America about an unauthorized electronic fund transfer related to a debit-card or ATM transaction.
- Bank of America denied that claim between May 6, 2023, and July 14, 2026. The date of the denial is the relevant period stated in the official class definition.
- A postcard or email notice means the parties believe you may qualify; it is not a substitute for meeting the class definition. The official FAQ does not state a separate state-residency restriction.
- You must submit a valid, timely claim to receive a payment or account credit. If you validly exclude yourself, you cannot receive settlement monetary benefits. If an account has multiple accountholders and one opts out, the FAQ says all accountholders on that account are excluded with respect to that account.

Frequently asked questions
How much will I receive?
The official FAQ describes equal shares of the net settlement fund for valid, timely claims. The $2 million gross fund also covers approved fees, litigation expenses, administration costs and a service award, so it is not all distributed directly to claimants. No fixed individual payment is promised.
What does the claim require?
The public online claim form asks for claimant/contact details, payment selection, an eligibility certification and a signature. You certify that Bank of America denied your unauthorized debit-card or ATM transfer claim during the class period and confirm the information is true and correct. Follow the official form and any administrator instructions; this is not a guarantee against further verification.
Do I receive money automatically?
No. The official FAQ says a valid, timely claim is required for a payment or account credit. Doing nothing means no settlement payment while remaining bound by the settlement if it becomes final.
Can the payment go to my Bank of America account?
The official form offers account credit if you have an open Bank of America account and choose that option. It also provides other payment choices. Follow the current official form to select an available method.
What is the deadline?
Online claims must be submitted by 11:59 p.m. Pacific Time on December 11, 2026. Mailed claims must be postmarked by December 11, 2026. These are different filing methods with the same stated calendar date.
Does this settle every claim about my disputed transaction?
The settlement releases the statutory-damages and injunctive-relief claims described in the official notice. Except for the named plaintiff’s separate release, the FAQ says it preserves actual-damages claims based on Bank of America’s alleged improper denial of unauthorized debit-card or ATM transfer claims. Read the official release before deciding whether to participate.
Is the settlement finally approved?
The official website describes a proposed settlement that still requires final court approval. No benefits will be provided unless the court approves it. No calendar payment date is confirmed.
