Administrator’s settlement FAQFAQ 13, approval and appeals

Who qualifies

  • You must have purchased a qualifying pool from a retailer for personal use before May 4, 2026. The court’s class covers people in the United States, including states, districts, territories and tribal reservations. Second-hand and resale purchases are excluded.
  • Check the model list in Exhibit E to the settlement agreement. Covered designs include specified Power Steel, Steel Pro and Coleman Power Steel models at least 48 inches tall with compression straps outside the vertical support poles. A brand name alone does not establish eligibility.
  • The administrator’s homepage describes purchases from 2008 through 2024. Bestway says it stopped making and selling the affected design in June 2024. The court’s order covers qualifying retail purchases before May 4, 2026. For example, the complaint describes a June 2025 retail purchase by a buyer the court later appointed as a class representative. If you bought in 2025 or early 2026, check your model against Exhibit E and contact the administrator if you are unsure whether it qualifies.
  • Excluded are the presiding judge and immediate family, the defendants and their parents, subsidiaries, affiliates and current or former officers, directors, employees, agents and counsel, people who validly opted out, successors or assigns of excluded people, wholesalers, distributors and retailers of the class products, second-hand purchasers, federal, state or local government entities, and class counsel.

How to file a Bestway pool settlement claim

  1. 1

    Identify your pool

Find the brand, height, diameter for a round pool or width and length for an oval pool. Prepare either its model number or serial number. The claim form says serial numbers are typically on the outside of the liner near the drain valve or pump inlet or outlet.

  2. 2

    Gather your purchase information

Record the approximate purchase date, retailer and personal-use purchase. A store receipt, online receipt or other objectively verifiable purchase record may qualify as proof. A household can file without that documentation, but must still supply the required pool and purchase information.

  3. 3

Complete and sign one household claim

Use the official claim form, fill in contact details and the applicable payment information, and sign the attestation that your information is true to the best of your knowledge. The administrator may ask for supplemental information before accepting the claim.

  4. 4

    Submit by November 19

File online through the official settlement website or send the completed form by U.S. mail to Bestway Settlement Administrator, P.O. Box 1869, Baton Rouge, LA 70821. A mailed claim must be postmarked by November 19, 2026. Keep a copy and update your contact details if they change.

Frequently asked questions

How much could my household receive?

With valid proof showing the price, the base payment is 10% of the actual amount paid. If valid proof identifies the qualifying pool but omits the price, the base payment is 10% of the average retail price assigned to that model. Without valid proof, the base payment is $40. The agreement permits proportionate increases from excess net funds under its allocation rules. If funds are insufficient, claims with valid purchase proof are paid first and claims without proof are reduced proportionately.

Can I file without a receipt?

Yes. You must still identify the qualifying product, supply its dimensions and model or serial number, give the approximate purchase date and retailer, confirm personal use, and sign the claim form. The administrator verifies claims and may request more information.

What if the claim form says October 30?

On November 3, 2026, the court granted a 20-day extension for filing claims. The administrator’s updated FAQ says to submit online or have a mailed claim postmarked by November 19. The order preserved all other deadlines.

What if I bought the pool on May 4, 2026?

The signed order defines the class as people who purchased before the date of preliminary approval, May 4. The form’s proof instructions also use the phrase “on or before” when describing documentation. Contact the administrator at 1-855-789-5948 about a May 4 purchase before submitting a claim.

Do I have to participate in the pool recall?

No. The settlement FAQ says recall participation is not a condition for a cash claim. The manufacturer’s recall and the settlement claim have separate procedures. Settlement participation does not limit rights under the recall.

When will payments be sent?

The court scheduled a fairness hearing for November 20, 2026. Payments require final court approval and resolution of any appeals. The hearing date is not a payment date.
