FN Logistics wage settlement: who needs to file by October 26
Last updated:
Sources last checked:
FN Logistics agreed to a $5,565,000 class and PAGA settlement for covered California workers. If you received the settlement notice by mail, you do not need to file a claim to receive your payment if the settlement becomes final. People who did not receive mailed notice must submit a documented claim through USPS that the administrator receives by October 26, 2026.
The class covers current and former hourly, nonexempt employees and temporary staffing-agency workers at FN Logistics or its predecessor in California from January 13, 2019 through December 31, 2024. Class payments depend on approved workweeks and the money left after settlement deductions; no fixed individual payout is promised.
A signed July 27, 2026 court order added the claim process for workers whose contact and work records were unavailable. The final approval hearing is scheduled for December 1, 2026 at 9:00 a.m. FN Logistics denies the wage-and-hour allegations. No payment date is guaranteed.

Who qualifies
- You worked in California as a current or former hourly, nonexempt employee of FN Logistics, LLC or its predecessor FN Logistics, Inc. during January 13, 2019–December 31, 2024, or worked at one of their California locations as a temporary worker placed through a staffing agency during that period.
- The class includes staffing-agency workers; the listed agencies are examples, not an exclusive list. Work outside California or outside the class period does not establish membership.
- PAGA members are class members who worked in the covered California operations during October 2, 2021–December 31, 2024.
- People who validly opt out of the class settlement do not receive a class payment. They cannot opt out of the PAGA portion and may still qualify for its payment. Consult the official notice and administrator before taking an exclusion or objection step.

If you did not receive mailed notice
Download the official four-page Claim Form and Release. Supply your contact information, number of California workweeks and a table identifying pay stubs or other records proving those workweeks. Send copies, not originals; include your name and signature on added sheets.

Personally sign and arrange timely delivery
The form requires your signature, date and printed name, a truthful certification under penalty of perjury, and acknowledgment of the settlement release. Mail one claim per person through USPS to Bucio v. FNL Settlement, Settlement Administrator, P.O. Box 26170, Santa Ana, CA 92799. It must be received by October 26, 2026; a same-day postmark is not enough.

Frequently asked questions
Does everyone need to file by October 26?
No. Direct mailed-notice recipients do not need to submit a claim for an automatic payment if the settlement is approved. The October 26 receipt deadline applies to claims by people without mailed notice. October 26 is also a response date for exclusions, written objections and record disputes, with separate requirements in the notice.
How much will I receive?
No universal amount is established. The net class fund is allocated according to each participating worker’s approved workweeks. PAGA worker payments use the proportion of covered pay periods. Court-approved fees, awards, administration and the PAGA allocation reduce the money available for class payments; tax withholding may also apply.
Is the $50,000 PAGA amount extra money beyond the fund?
No. The agreement allocates $200,000 from the $5,565,000 gross fund to PAGA penalties: 75% ($150,000) to California’s LWDA and 25% ($50,000) to workers. That worker share uses covered PAGA pay periods, not class workweeks. The claim form’s shorthand description does not increase the gross fund.
Why does the older notice say no claim is required?
The original settlement used employer and staffing-agency records for automatic payments. The court’s July 27 amendment added a claim process for workers whose contact and work records were missing. The current claim form expressly preserves automatic payments for people who received mailed notice.
What expenses come out of the settlement?
The fund covers court-approved attorney fees and costs, representative awards, administration and PAGA penalties as well as worker benefits. The July 27 amendment raised the administration cap to $125,000; the older $32,000 figure in the notice and FAQ was superseded. Final deductions remain subject to court approval.
When will checks arrive?
There is no guaranteed arrival date. The December 1 hearing is for final approval. Payments depend on finality, funding and administration. Review your eventual check’s void date and keep your address current.
