How we verify settlements

Hospital Español Auxilio Mutuo de Puerto Rico, Inc. agreed to a settlement for U.S. residents whose personal information may have been accessed or acquired in its September 2023 data incident. Eligible members may claim either documented losses up to $2,500 or a $25 alternative payment by December 21, 2026. The two cash options cannot be combined.

The $500,000 cap applies to monetary benefits, and payment is not guaranteed at either advertised amount. Approved loss claims are paid first. If they exhaust the cap, alternative cash claims receive nothing; otherwise the $25 payments may be reduced proportionally. Members who stay in the settlement are also offered two years of credit and medical monitoring without filing a cash claim, but must enroll and activate the service after the settlement becomes effective.

Who qualifies

  • You reside in the United States and your personal information may have been accessed and/or acquired by an unauthorized party as a result of the September 2023 cybersecurity incident against Hospital Español Auxilio Mutuo de Puerto Rico, Inc. A hospital visit alone does not establish inclusion; check your data-incident or settlement notice, or contact the administrator.
  • The class excludes the defendant; people who timely and validly opt out; judges assigned to the case and their staff and family; and people found criminally guilty of initiating, causing, aiding or abetting the incident, or who plead nolo contendere to such a charge.
  • For a loss reimbursement, the loss must be actual, documented, unreimbursed and more likely than not caused by the incident. It must have occurred between September 2023 and December 21, 2026. You must have made reasonable efforts to avoid or recover the loss, including exhausting available credit-monitoring or identity-theft insurance.

How to claim an Auxilio Mutuo settlement payment

  1. 1

Confirm your notice and choose one cash option

Use the official administrator website and confirm that your notice concerns this hospital’s September 2023 incident. Choose documented losses up to $2,500 or the $25 alternative, not both. Both amounts remain subject to the monetary cap and loss-claim priority.

  2. 2

Complete and sign the official form

Provide your name, contact details and Class Member ID if known. Sign and date the truthfulness attestation. For loss claims, list the costs, dates and amounts and attach receipts or other third-party evidence linking them to the incident. Self-prepared notes alone are insufficient. The $25 alternative does not require loss documentation, but still requires a valid claim.

  3. 3

    Submit by December 21, 2026

Submit the online form through the official website, or mail the completed signed paper form with supporting documents to Hospital Español Auxilio Mutuo De Puerto Rico, Inc. Data Incident, c/o Kroll Settlement Administration LLC, P.O. Box 225391, New York, NY 10150-5391. Mailed claims must be postmarked by December 21. The form says online claims are due by 11:59 p.m. but does not specify a time zone; confirm the cutoff with Kroll rather than assume one.

  4. 4

Keep your details current and watch for approval

The paper form provides payment by check; use the online form for an electronic payment selection. Keep your address current with Kroll. Monitoring codes are provided with the notice, with enrollment and activation after the settlement becomes effective. Call (833) 453-0919 if you do not have your code. Frequently asked questions

Is the $25 payment guaranteed?

No. The agreement pays approved documented losses first. If those claims exceed the $500,000 monetary cap, they are reduced proportionally and no funds go to alternative cash claims. If funds remain but cannot cover all $25 claims, alternative payments are reduced proportionally.

Can I claim both $25 and documented losses?

No. Select one cash option. Eligible members who do not opt out also receive an opportunity to enroll in two years of one-bureau credit and medical monitoring through CyEx, with fraud protection, separately from the cash choice.

Do I need proof or a notice ID?

The paper form asks for your Class Member ID if known and requires contact information, signature and date. A loss claim requires third-party documentation of actual unreimbursed losses more likely than not caused by the incident. The $25 alternative requires a valid claim but no loss documentation. Ask Kroll if you need help locating your record.

Do I need a claim form for monitoring?

No. Agreement paragraph 58 expressly provides the monitoring offer and code automatically with the notice; you must enroll and activate after the Effective Date. This specific provision, also repeated in FAQ 10 and the claim form, controls the monitoring explanation despite FAQ 22’s generic statement about receiving no benefits if you do nothing. Cash benefits still require a timely valid claim.

When is final approval and when will payment arrive?

The hearing is scheduled for January 20, 2027. The signed August 24 order and FAQ 20 say 1:30 p.m. (FAQ 20 specifies AST), while the website sidebar says 9:30 a.m. AST. The order permits later schedule announcements on the website, so the current hearing time remains unclear; confirm it with Kroll before attending. No payment arrival date is promised. Distribution depends on final approval and resolution of challenges.
