How we verify settlements

Eligible U.S. residents affected by the December 2023 Peco Foods data breach can submit a claim by November 9, 2026. The class covers people whose personal information was accessed or acquired in the breach described in Peco’s notices sent around July 24, 2024.

The $950,000 settlement offers qualifying ordinary losses up to $1,000, extraordinary losses and eligible time up to $5,000, a residual cash payment up to $550 if funds remain, and three years of credit monitoring. These are separate conditional benefits. Cash amounts may be reduced and are not guaranteed.

Peco denies wrongdoing. The settlement has preliminary approval; benefits depend on final approval and resolution of possible appeals. The final approval hearing is scheduled for December 14, 2026 at 11 a.m. Central Time.

Who qualifies

  • You are an individual U.S. resident whose personal information was accessed or acquired in the Peco data breach described in notices sent around July 24, 2024. The agreement includes the District of Columbia and U.S. territories in “United States.”
  • A Peco breach notice helps identify affected people. The claim form includes people who received notice but does not make having a notice letter the sole test. If you are unsure, ask the administrator to confirm your membership.
  • Excluded are the presiding judge, court staff and the judge’s immediate family; Peco officers, directors, members and shareholders; valid timely opt-outs and their successors and assigns; and people convicted of, or pleading no contest to, specified criminal involvement in the breach.
  • You must submit a valid claim for each benefit you request. Loss reimbursement requires qualifying actual unreimbursed losses connected to the breach and supporting documentation.

How to file a claim

  1. 1

    Check your eligibility

Review your Peco breach notice and the class definition. For help, contact the administrator at 1-855-557-9411 or info@PecoFoodsDataSettlement.com. The paper form asks for your Claim ID if known. The online form requires your Settlement Claim ID and offers help locating it.

  2. 2

Select the benefits you qualify for

You may select more than one benefit: ordinary losses, extraordinary losses with qualifying attested time, residual cash and credit monitoring. Select credit monitoring on the form if you want that service.

  3. 3

    Provide documentation and sign

Provide your name, mailing address, email and phone number. Attach supporting records for claimed losses; self-prepared records alone are insufficient. For qualifying time, describe the actions taken and time spent. Sign and date the claim certification.

  4. 4

    Submit by November 9

Submit online by November 9, 2026 at 11:59:59 p.m. Central Time, or mail the completed form to Peco Claims Administrator, P.O. Box 1828, Baton Rouge, LA 70821, postmarked by November 9. The paper form also mentions email submission; contact the administrator for instructions before using that method.

Frequently asked questions

How much is the residual cash payment?

It is capped at $550 and is payable only if funds remain. The amount depends on approved claims and funds left after credit monitoring, loss reimbursements, administration, approved attorneys’ fees and costs, and service awards. It may be lower than $550, and no payment amount is guaranteed.

Can I claim both ordinary and extraordinary losses?

Yes, if you meet each category’s requirements. Ordinary unreimbursed losses incurred from December 4, 2023 through the claim deadline are capped at $1,000. Extraordinary losses fairly traceable to the breach are capped at $5,000 and must not be reimbursable as ordinary losses. For identity theft or fraud, the agreement requires losses on or after December 4, 2023 involving the same type of personal information provided to Peco. The notice also calls for reasonable efforts to avoid or seek reimbursement for extraordinary losses, including available credit monitoring assistance and identity theft insurance. Approved reimbursements may be reduced proportionately if the available fund is insufficient.

Can I claim time spent dealing with the breach?

Only class members with valid documented extraordinary losses may claim up to 10 hours at $40 per hour. Provide an attestation and a brief description of the actions and time spent. This time payment is included within the $5,000 extraordinary-loss limit, not added on top.

What proof do I need?

Loss claims require supporting records such as receipts, plus an attestation that the claimed losses are actual and unreimbursed. Self-prepared records can explain other evidence but are insufficient alone. Residual cash and credit monitoring do not require proof of a monetary loss, but you still must be a class member and complete a valid signed claim. The administrator may ask for more information. Notarization is not required.

Do I receive credit monitoring automatically?

No. Select credit monitoring on the claim form to request three years of monitoring at all three credit bureaus. The notice says its duration may be reduced if monitoring costs alone would exhaust the net fund.

When will I receive benefits?

Benefits depend on final approval and resolution of any appeals. The hearing is scheduled for December 14, 2026 at 11 a.m. Central Time; check the official website for changes. No guaranteed payment date is stated.

Can I still opt out or object?

The notice lists October 12, 2026 for opting out or objecting; that date has passed. Those procedures are separate from the November 9 claim deadline.
