How we verify settlements

Kisco Senior Living has agreed to a proposed $1.8 million settlement over a data incident that occurred on or around June 1–6, 2023. The settlement class consists of individual U.S. residents to whom Kisco sent written notification of the incident, subject to the official exclusions.

Eligible claimants can request qualifying ordinary loss reimbursement up to $1,000, extraordinary loss reimbursement and qualifying attested time within a $10,000 limit, three years of credit monitoring, and a share of any residual cash. Class members who lived in California at any time from June 1–6, 2023 may also claim a $250 statutory payment. Awards may be reduced proportionally, and residual cash depends on funds remaining.

A valid claim is required. Claims must be received online or postmarked by January 19, 2027. The official form requires a unique CPT ID, appropriate documentation and attestations, and a signed affirmation.

The case is Gois, et al. v. Kisco Senior Living, LLC, No. 24-cv-751-BJC-AHG, in the U.S. District Court for the Southern District of California. Kisco denies wrongdoing. Payments depend on final approval and resolution of any appeals.

Who qualifies

  • You must be an individual U.S. resident to whom Kisco sent written notification of the June 2023 data incident.
  • Excluded are the presiding judges, their staff and immediate families; Kisco officers, directors, members and shareholders; people who validly opt out and their successors or assigns; and people convicted of, or pleading no contest to, specified criminal involvement in causing the incident.
  • The California statutory payment requires California residency at any time from June 1 through June 6, 2023. The claim form requires an attestation under penalty of perjury.
  • Ordinary losses must be unreimbursed costs of responding to the incident notice. Extraordinary losses must be actual, documented, unreimbursed, more likely than not caused by the incident and not already covered by another reimbursement category. The covered loss period runs from June 1, 2023, or the earliest verifiable incident date, through the claim deadline. Extraordinary-loss claimants must make reasonable efforts to avoid the loss or obtain reimbursement, including exhausting available identity-theft or credit-monitoring insurance.

How to submit a Kisco settlement claim

  1. 1

Locate your notice and CPT ID

Check that you meet the class definition and exclusions. Online filing requires your CPT ID and passcode. Contact CPT Group through the official settlement website if you need help locating your credentials.

  2. 2

Choose each benefit you are claiming

Select the applicable cash benefits and credit monitoring on the official form. A residual cash claim may be made by itself or alongside other benefits; its amount depends on the fund remaining after other approved benefits and costs.

  3. 3

    Prepare records and attestations

Provide loss records such as receipts and an explanation where needed. Self-prepared records alone are insufficient for loss reimbursement. For qualifying time, describe each action and its time and attest under penalty of perjury. Complete the California-residency attestation if claiming that benefit.

  4. 4

Complete the affirmation and file by January 19, 2027

Check the required affirmation box, sign, print your name and date the form. Submit online at the official portal or mail the signed claim and supporting copies to Gois v. Kisco Senior Living, LLC, PO Box 19504, Irvine, CA 92623. Online receipt or a mailing postmark must be no later than January 19, 2027. No exact cutoff time or timezone is stated in the reviewed instructions.

Frequently asked questions

Can I claim without documented financial losses?

Yes, eligible class members may request credit monitoring and residual cash without having identifiable losses. Eligible California residents may request the statutory payment without unauthorized charges or identifiable losses. You still need a valid claim, the required notice credentials and attestations. Residual cash is payable only if funds remain.

What time reimbursement is available?

Up to five hours at $30 per hour, with at least one full hour spent. This applies only to time addressing identity theft or fraud, falsified tax returns or other possible misuse of personal information related to the incident. Give a brief description of the actions and time and attest under penalty of perjury. Time reimbursement falls within the $10,000 extraordinary-loss/time limit; it is not an additional $150 above that limit.

Are the stated amounts guaranteed?

No. Ordinary-loss, extraordinary-loss/time and California payments may be reduced proportionally if the available fund is insufficient after credit monitoring, administration, approved fees, expenses and service awards. Any remaining fund is divided among people with timely approved claims, including approved claims for other benefits. The final residual cash amount is unknown.

What happens if documents or information are missing?

The administrator reviews each claim and may request more information. Failure to provide required information on time can invalidate the claim. Submit copies of supporting records and retain originals. The form requires certification that supporting documents are unaltered.

When will payments be sent?

Only after final settlement approval and resolution of any appeals. The final approval hearing is scheduled for March 18, 2027 and may change. A payment date is not promised in the issued notice.
