How we verify settlements

Eligible patients, patient designees and patient representatives may claim a payment for HealthPort medical-record requests made to Pennsylvania providers or facilities in connection with applications for life or health insurance. The covered period is December 17, 2009 through July 23, 2026, and the class excludes requests charged at an agreed-upon rate.

The benefit is calculated as 67.5% of qualifying alleged overpayments determined by the settlement administrator. The agreement makes up to $197,720.39 available for valid claims and provides proportional payments if valid claims exceed that amount. Individual awards therefore depend on eligible transactions and the settlement rules.

A completed, signed Proof of Claim must be received through the official settlement website by December 31, 2026. The agreement sets the online cutoff at 11:59 p.m. Eastern Standard Time. Use your Notice ID and PIN to review the transaction list and complete the claim.

This is P.I.T. Retrievals, LLC v. HealthPort Technologies, LLC, case GD-13-023729 in the Court of Common Pleas of Allegheny County, Pennsylvania. It is separate from the Landay v. Datavant settlement, case GD-09-012923. Payment depends on final approval and resolution of any appeals.

  1. 1

    Confirm the correct settlement

  3. 3

Complete and sign the Proof of Claim

Provide all requested information accurately and truthfully and sign under penalty of perjury. The administrator may request additional information to validate your claim. You may claim all eligible listed transactions or select fewer transactions.

  4. 4

    Submit online by December 31

Your claim must be received through the official settlement website by December 31, 2026, at 11:59 p.m. Eastern Standard Time. The reviewed claim instructions require online submission; the separate mailed exclusion procedure is not a claim-filing option.

Frequently asked questions

Is this the same as the Landay v. Datavant settlement?

No. This page covers P.I.T. Retrievals v. HealthPort, GD-13-023729, for medical-record requests connected to life or health insurance applications. The official notice identifies Landay v. Datavant, GD-09-012923, as an unrelated lawsuit with different deadlines.

Will I receive exactly 67.5% of all fees I paid?

The formula applies to qualifying alleged overpayments, not all record-copying fees. The administrator calculates these amounts from the relevant transactions. The agreement caps valid-claim funding at $197,720.39 and requires proportional payments if valid claims exceed that amount.

What information do I need?

Use your Notice ID and PIN to access the prepopulated Proof of Claim and transaction list. Complete all requested information and sign under penalty of perjury. The administrator may request additional information to determine validity; this is not a promise that every claim is accepted without supporting information.

Can I mail my claim?

The current notice requires the Proof of Claim to be received through the settlement website. The mailed exclusion procedure is separate from claiming payment.

When will payments arrive?

Payments depend on final settlement approval and resolution of any appeals. The official FAQ does not give a guaranteed payment date.
