Tyson Beef Direct Purchaser Antitrust Settlement
Last updated:
Sources last checked:
Tyson agreed to an $82.5 million settlement, including $2.5 million for notice and administration, in litigation over alleged beef price fixing. Eligible people and businesses bought qualifying beef directly from Cargill, JBS, National Beef or Tyson, or their subsidiaries or affiliates, for use or delivery in the United States from January 1, 2015 through February 29, 2020.
New claims must be submitted online or mailed postmarked by November 30, 2026. An approved claim in the earlier JBS settlement generally carries over without a new claim, but revised product exclusions can change recognized purchases and prior supplemental documentation may need to be resubmitted. Payments depend on qualifying purchases, available net funds and court approval.

Who qualifies
- People and entities must have purchased covered beef directly from Cargill, Inc.; Cargill Meat Solutions Corporation (also called Cargill Protein); JBS S.A.; JBS USA Food Company; Swift Beef Company; JBS Packerland, Inc.; National Beef Packing Company; Tyson Foods, Inc.; Tyson Fresh Meats, Inc.; or their subsidiaries or affiliates, for use or delivery in the United States during January 1, 2015–February 29, 2020. An ordinary grocery-store purchase does not establish a direct purchase from these producers.
- Covered beef is fresh or frozen boxed or case-ready beef made from U.S. fed cattle and derived from chuck, loin, rib or round. Excluded products include ground beef; products marketed as organic, grass-fed, kosher, halal, certified humane, Wagyu or American-Style Kobe Beef; and cooked, marinated, seasoned, flavored or breaded products. Other further-processed meat is excluded except case-ready beef, as are drop byproducts such as trim, fats, oils, hides and offal.
- Excluded people and entities include the defendants and their officers, directors and employees; defendant-controlled entities; defendants’ affiliates, legal representatives, heirs and assigns; federal, state and local governmental entities; the presiding judicial officer and immediate family and judicial staff; assigned jurors; and anyone who properly opted out of the Tyson settlement.
How to claim or review an existing claim
- 1
Check whether your earlier claim carries over
If you already filed an approved JBS claim, do not submit a duplicate solely to receive Tyson benefits. Review your recognized purchases: the Tyson class excludes ground beef and drop byproducts, and documents supplementing a JBS claim may need to be submitted again. A Tyson claim already submitted also need not be resubmitted.
- 2
Review your purchase records
A prepopulated form lists known purchases; use the Unique ID and PIN from your notice to review them through the official login. If the amounts are correct, complete and sign the form. If you disagree or need to supplement them, complete the Purchase Audit Request Form with supporting records. The blank online form is available for purchasers without prepopulated records.
- 3
Document new or revised purchases and sign
For a blank claim or revised purchases, provide a table or spreadsheet covering all purchases claimed, identifying the defendant, year, beef product and purchase amount. Supply actual receipts or invoices showing product name, defendant manufacturer, purchase date and net amount. Keep originals and send legible copies. Sign the certification that the information is true and you are authorized to act for the purchaser; additional information may be requested.

Frequently asked questions
Is this for shoppers who bought beef at a supermarket?
The class requires purchases directly from the named producers or their subsidiaries or affiliates. Buying beef through an unrelated grocery store or distributor does not satisfy that requirement.
How much will I receive?
There is no fixed individual payment. The administrator calculates each valid claimant’s proportional share using verified qualifying purchase dollars compared with all qualifying purchases claimed. Notice and administration costs and court-approved legal fees, litigation costs, service awards and future litigation costs reduce the money available to claimants.
Do all claims require new receipts?
A claimant accepting the amounts on a prepopulated form can complete and sign that form. New blank claims and disputed or supplemental purchase amounts require actual receipts or invoices supporting the entirety of the purchases being claimed. Prior JBS supplemental documents may need to be resubmitted under the narrower Tyson product definition.
Does an approved JBS claim guarantee a Tyson payment?
It makes you automatically eligible without another claim form, but payment still depends on qualifying purchases under the Tyson class definition, claim review, final approval and the distribution process. Ground beef and drop byproducts recognized in some earlier JBS claims are excluded here.
What if I opted out of JBS?
The amended notice says a person who excluded themselves from JBS may claim in the Tyson settlement if otherwise eligible and not excluded from Tyson. The earlier JBS claim deadline has passed; this filing window does not reopen it.
When will payment arrive?
The Court must approve the settlement and a distribution plan, appeals must be resolved, and the administrator must finish claim processing and disputes. No fixed payment date is established. The amended notice and signed September 14 order set the fairness hearing for November 12, 2026; a scheduled hearing is not approval.
